1. Agreement to these Terms
FosterPanel provides a server and infrastructure management platform: container orchestration, firewall and protection controls, storage, proxy/domain tooling, credentials vault features, billing, and related operations.
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” includes the organization.
If you do not agree, do not use the Service.
2. Accounts & eligibility
- You must provide accurate registration information and keep it up to date.
- You are responsible for activity under your account, including collaborator seats you grant.
- Keep credentials, API tokens, agent keys, and recovery codes confidential.
- Notify us promptly if you suspect unauthorized access to your account or servers connected through FosterPanel.
- We may suspend or restrict accounts that present security risk, abuse, or unpaid invoices.
3. Subscriptions & billing
FosterPanel offers a Free tier and paid monthly plans (for example Starter, Medium, and Max). Paid plans are billed in advance for each monthly billing period through our payment processor (currently Paddle), unless otherwise stated at checkout.
When you activate a monthly package, the plan advantages and entitlements apply for that billing period and continue while the subscription remains active. If you cancel, access to paid features continues through the end of the period already paid for; it does not end mid-cycle unless we state otherwise for a specific promotion or legal requirement.
Plan limits (servers, domains, protection features, seats, and similar entitlements) are described in the panel billing UI and may change with notice as described in section 11.
4. Refund policy
All sales of paid FosterPanel subscriptions are final. We do not provide partial or full refunds for unused time, change of mind, misconfiguration, unused features, or mid-cycle cancellation.
- Monthly packages. When you activate a monthly plan, you receive the advantages of that plan for the paid period. Those advantages remain available until you cancel, and after cancellation they last until the end of the already-paid billing period.
- No prorated cash-back. Cancelling stops future renewals; it does not create a refund for time remaining in the current period.
- Charge disputes. If you believe a charge is erroneous, contact us promptly with invoice details so we can investigate with our payment processor. Statutory rights that cannot be waived in your jurisdiction still apply.
5. Account deletion & full wipe
Because FosterPanel may hold company and infrastructure data (server metadata, proxy domains, credentials references, billing linkage, protection settings, and related operational records), account deletion is designed as a full wipe: every bit of account-associated information we control is removed when deletion completes.
- You request account deletion from the panel (or via support where required).
- A 30-day waiting period begins. During this window you may opt out / cancel the deletion request and keep the account.
- If you do not opt out before the waiting period ends, we permanently wipe account data. This action is irreversible.
- Deletion does not automatically uninstall agents or destroy resources on your own servers; you remain responsible for host-side cleanup.
- Some records may be retained briefly where required for security, fraud prevention, legal compliance, or payment reconciliation, then removed or anonymized.
- Active subscriptions should be cancelled before or as part of deletion; fees already paid remain subject to the refund policy above.
6. Security, encryption & two-factor authentication
We take data privacy and operational safety seriously. Sensitive data and critical operations are protected with encryption and verification controls appropriate to the Service.
- Encryption in transit. Panel and API traffic is served over HTTPS/TLS.
- Sensitive operations. Credentials, agent authentication material, and similar secrets are handled with encryption and access controls; agent identity uses cryptographic verification (for example Ed25519-based checks) where applicable.
- Mandatory 2FA for critical actions. Two-factor authentication (step-up verification) is required for several critical operations in the panel—such as sensitive configuration changes, destructive actions, and other elevated flows. You must keep 2FA available and recoverable. Disabling required controls where the product mandates them may block those operations.
- You are responsible for securing your connected servers, SSH keys, firewall exposure, and DNS. FosterPanel tools assist management; they do not replace sound host security practices.
7. Acceptable use
You agree not to:
- Use the Service for unlawful activity, abuse, or to attack third-party systems.
- Attempt to bypass authentication, 2FA, billing entitlements, or agent trust controls.
- Interfere with Service integrity, scrape in an abusive way, or overload shared infrastructure.
- Resell or redistribute the Service except as expressly allowed in writing.
- Upload malware or misuse protection/firewall features to harm others.
We may investigate and suspend access for violations, with or without notice when urgency requires it.
8. Data & privacy
Our collection and use of personal data is described in the Privacy Policy. By using the Service you also acknowledge that policy. Where privacy terms and these Terms conflict on data-protection topics, the Privacy Policy controls for those topics.
10. Disclaimers & limitation of liability
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
You acknowledge that managing servers, containers, firewalls, certificates, and storage carries inherent risk. You are responsible for backups, change control, and validating operations before production use.
To the fullest extent permitted by law, FosterPanel’s total liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the three (3) months before the claim. We are not liable for indirect, incidental, special, consequential, or lost-profit damages.
11. Changes to the Service or Terms
We may update these Terms or the Service features over time. Material changes will be reflected by updating the “Last updated” date on this page and, where appropriate, additional notice in the panel or by email. Continued use after changes become effective constitutes acceptance of the revised Terms.
